Terms of Use for In-Person and Online Spaces (Including Community Platforms)

​

Thank you for participating in our in-person, online, web-based, resource-based, community-based and social media events. We offer a mix of offerings that are often interrelated or hybridized with in person or online offerings at Togetherly, LLC, or Kathryn Para, Frolic the Fox, GuideNtoes™, Ukify™, Yoga, Empowered and other offerings. We hope the terms of use posted below are clear and invite any questions or concerns to Frolic@KathrynPara.com where we hope to address them. Togetherly, LLC is a small, disabled veteran owned, woman-owned company that is working to make a true impact for children and their families their caregivers and their educators.

Definition of Sites

​​

For the purpose of these Terms of Use, "site" or "sites" refers to any website or online platform containing material or content by Kathryn Para, Frolic the Fox, Togetherly, LLC, or their associates, partners, instructors or collaborators. This includes, but is not limited to kathrynpara.com and connected URLs, Wix Spaces, Mighty Networks operated by Togetherly, LLC and Kathryn Para & Frolic the Fox and social media or hosting sites.

Intellectual Property

​

All works contained or created within these sites, including but not limited to music, lyrics, movement sequences (with exception of ancient yoga practices), business and educational practices, tools and methods and other creative content, are the property of Kathryn Para. These works are protected by copyright laws and may not be used, reproduced, or distributed without explicit permission from Kathryn Para. Trademarks and processes owned by Kathryn Para may not be copied or used in any way. Creation of songs, writings, materials tools or any other creation in-person on site or within events is not a work for hire and remains the sole intellectual property of Kathryn Para and Togetherly, LLC. Any material posted, shared or created within site or events posted by members, attendees, participants or users may be used, copied, shared and published by Togetherly,  LLC, associates. â€‹

Usage Restrictions

​

The use of songs, tools, and any other materials within these sites is intended for personal, home, and small group use only. Any commercial use, public performance, or distribution of the content requires prior written consent from Kathryn Para. Please contact us for inquiries regarding other uses. Please note that music licensing restrictions may be in place by 2025, which may modify permissions to use songs. Access to online spaces, resources, communities will be shifting to more restricted status or private access. We reserve the right to change access to any material, songs, videos or other work at our discretion and make no promises, warranties, either explicit or implied, that access or permissions to use any materials or information on these sites will remain.

Member Contributions

​

Any posts or contributions from members must be of their own creation and may not violate another person's intellectual property rights. If quoting or referring to any other source, please provide adequate attribution and links, if possible.

Rights to Use Member Content

​

Kathryn Para, Togetherly LLC, and its partners reserve the right to use any content, including images, videos, comments, and other materials, posted by members in these sites. This content may be used for promotional, marketing, or other purposes.

Any photo, video, or writing contributions made by members or parties using these sites may be used for marketing, creative, testimonial, or other purposes. By making a contribution, you grant us permission to use and publish the content.

Acknowledgement of Recordings Including Minors

​

We want participants, including parents and guardians minors under the age of 18, to be fully aware and informed that all classes, offerings, and events conducted in person, on websites, groups, programs and platform and in-person will likely be recorded. This includes the capturing of photos, videos, and audio. Participation in these activities implies your acknowledgement and consent to these recordings.

As a parent or guardian of a minor under the age of 18, your consent on their behalf is required for their participation and the subsequent recording of their activities on this platform, these websites and in any in-person or online event or meet-up. You assert that you have legal standing to grant these permissions.

​

We take these recordings for a variety of reasons. The primary reason is that Kathryn Para creates original work in the middle of performances quite frequently. By recording the concerts, it provides a fixed medium needed to legally establish copyright. Creating a fixed recording establishes copyright and protects us in ownership of intellectual property. This also protects the ownership rights if another participant captures and shares Kathryn’s work. Other reasons include but are not limited to: improving our offerings, for archival purposes, to continually enhance the quality of our community and the services we provide, understand what parts of original work are going well or need improvements, remembering what we did (Kathryn is often pivoting and creating a new way of doing something or a new script in the the midst of a class and she wants to remember what she does.) Kathryn also needs photos and videos for promotional purposes, to show what we do. Because our work is so original, there are not stock images to show what we do. Photos, videos and audio will help us tell the story of what our offerings look like and can be used in the creation of professional and parental development programs. We do our best to cover faces or identifying characteristics, regardless of whether permission is given with little emojis when we use images that contain children. They also serve as a record of interactions for safety reasons and for full transparency. In some cases, we will record classes or parts of classes for purposes of a live streaming or to add to class resources adding to class or community resources. For example, some original yoga sequence phrasing or songs may be recorded and posted in the class site or shared with students or teachers. We will also encourage sharing photos and video within the private group for the class.

However, we respect your privacy and understand that not everyone, especially minors or those responsible for minors, might be comfortable with this. If you or your child do not consent to being recorded please refrain from participating. However, we do wish to enable comfortable participation and to be respectful of wishes. Please reach out to us with ample time before events and we will work to figure out a solution. Perhaps we can aim the camera away from where your child will be sitting, for example. Please do keep in mind that your participation and contributions greatly enrich our community and its offerings. Togetherly, LLC, Kathryn and our partners are building a resource of tremendous tools to help enhance the lives of children and their families and caring adults. Thus, while we respect your decisions, we also hope for your understanding of our need to conduct these recordings.

Privacy and Discretion in Posting

​

We value the privacy of all members of our community. We urge all users to exercise discretion when posting photos or videos, especially those featuring minors. Please ensure you have the express permission of the individual or their legal guardian before sharing any identifiable images or videos on these sites. While members and attendees of classes have likely approved the taking of pictures, please use discretion when sharing, posting or using media captured in classes posted in the private group for parents.

Liability Waiver for Mindfulness, Meditation, Yoga, Movement

​

You acknowledge that yoga, meditation, breath work, mindfulness and movement and music and professional development have inherent risks. You assert that you are the parent or legal guardian of each child participating in person, online or on connected sites and platforms and that If you and/or your child(ren) are participating in any of the activities with Kathryn Para, Frolic the Fox, Togetherly, LLC, sub contractors, substitutes, partners or collaborators participating or providing services in person, within website, resource platforms, community platforms or connected websites or social media sites. You understand and agree to waive any liability for injuries or damages that may occur. It is your responsibility to ensure that you or your child are physically and mentally capable of engaging in such activities and to consult a qualified professional if you have any concerns or medical conditions. The facilitator, as well as Togetherly, LLC, Kathryn Para, Frolic the Fox, and contributing partners, shall not be held responsible for any injuries or damages resulting from your or your child's participation.

As consideration for being permitted to participate in the wellness and wonder classes and workshops taught by our instructors, performers, partners, you hereby agree that you, yourself self, your assignees, heirs, guardians and legal representatives will not claim against, sue or attach the property of the Instructor, Togetherly, LLC, Yoga Barn, subcontractors and partners for injury or damage resulting from your participation in any aspect of the Togetherly, LLC, Yoga Barn subcontractors or partners; including including movement, meditation, mindfulness, consultation, music, storytime or other activities. I hereby release the Instructor, Togetherly, LLC, Yoga Barn, partners and all agents and heirs from any and all such actions, claims or demands that you, yourself, your assignees, heirs, guardians and legal representatives now have or hereafter may have for injury or damage associated with my participation in ANY offerings of the Instructor and for all claims, injury damages or liability suffered by you in connection with my participation. Individuals hereby acknowledge that before participating in a class or program involving exercise, they should consult with a physician. You have carefully read this entire agreement and fully understand the above contents. You am aware and agree that this is a complete release of liability voluntarily assumed for my participation in all activities with the Instructor, Togetherly, LLC, and partners.

I am aware that participation in the Togetherly Wonder and Wellness Class may be a hazardous activity. I acknowledge that a certain minimum level of physical health, strength, fitness, and flexibility will be required. You am voluntarily participating in these activities with knowledge of the risks of injury for which you will voluntarily assume.

In-Person and Online Yoga Classes Disclaimer

​

Like all exercise, yoga and movement has inherent risks for injury, illness or death. Always consult with a healthcare professional before starting any new exercise regimen or continuing after medical changes, including yoga, mindfulness, and movement. By participating in any events, workshops or classes, you certify that you have verified that you and any participants for which you are responsible or for which you have registered understand this and have verified your health status is suitable for exercise. 

 

Additionally, always consult with your supervisors, professional leadership, or other professionals when integrating concepts and suggestions from workshops, keynotes, or other professional and parental development initiatives. By participating in our in-person or online classes, workshops, events or keynotes, you assume all risk and responsibility associated with these activities.

Please note that while we strive to provide accurate and helpful information during in-person or online yoga, movement, music, mindfulness, breathing, meditation, art, or any other workshop, keynote, or class we offer, it is ultimately the participant's responsibility to verify all information and suggestions. We cannot guarantee the accuracy, completeness, or suitability of the advice given during these activities, and we are not responsible for any actions taken based on this advice. Be aware that some restrictions or recommendations may vary by location, school district, state, or country.

While every effort is made to provide accurate and reliable information within these sites or in person we make no representations or warranties of any kind, expressed or implied, about the completeness, accuracy, reliability, suitability, or availability of the information, products, services, or related graphics contained within the platform. Any reliance you place on such information is therefore strictly at your own risk.

By accessing this material, and anything that may be of a physical nature within this space or sites operated by Kathryn Para, Frolic the Fox, Togetherly, LLC, you participate at your own risk and certify that you or your child are of legal age to make choices and that you or your child is consulting a physician about safety.

Sign Language

​

We seek to honor deaf culture and inclusivity. Some ASL words are mixed in with our whole body movement. This is done to help introduce sign language to children and to assist young children in learning language. Additionally, it aids special needs and non-verbal children in communication. We will try to indicate when ASL is used. Some signs may have adaptations to make it easier for young children or individuals with autism. Big and little body movements are included to help stimulate brain chemistry and foster unity within the group.

We gratefully receive any feedback, corrections, suggestions, or other contributions related to sign language or inclusivity.

Diversity and Safe Community

​

We honor and celebrate all forms of diversity, including race, gender, melanin, culture, sexual orientation, religion, body diversity, and neurodiversity. We recognize the sense and need for a safe community. Acts of bigotry, microaggression, or disrespect will not be tolerated. We are all learning and growing together. If anyone feels uncomfortable with any communication, including ours, we request that you make us aware so that we can address it promptly.

Content Restriction and Removal

​

Creators have the right to restrict, remove, block, or delete any content or member from this site or any in-person class or gathering for any reason without refund.
